Employment counseling service is defined in the California Civil Code as any person who offers, advertises, or presents it can or will provide any of the following services for a fee:

- Aptitude testing
- Executive consulting
- Personnel consulting
- Career management
- Evaluation or planning
- The development of resumes and other promotional materials relating to the preparation of employment
Every employment counseling service must have a California Employment Counseling Bond on file that has been issued by a surety company that is certified to do business in the State of California. The amount of the bond is set at $10,000. The bond is an agreement between three parties: the applicant (obligee), the state and the surety company. It serves as an assurance to the state that the applicant will conduct their business legally and professionally. It will be for the benefit of any person or persons damaged by any violation of the code or by fraud, dishonesty, misstatement, misrepresentation, deceit, unlawful acts or omissions, or failure to provide the services of the employment counseling service or its agents.
